Meagher + Geer congratulates litigators Lenae Pederson and James Sweeney on securing a total defense verdict  for their third-party defendant subcontractor client following a seven-day jury trial in Hennepin County District Court.

The case involved a condominium HOA bringing suit against its former board president, who also built the property and continued to reside in the community, and his construction company for damages arising from the former president’s original construction and subsequent maintenance of the condominium. The former president brought third-party claims against our subcontractor client related to our client’s role in the original construction of the condominium.

At trial, the jury found our client not liable for any work it performed in the original construction and ultimately found the HOA and former president both negligent in their maintenance of the condominium. The jury also found that no warranties stemming from the original construction were breached. While the plaintiff and defendant split liability for many of their claims and counterclaims, our client was totally absolved of culpability.
