Meagher & Geer lawyers Chuck Spevacek, Bill Hart, and Damon Highly represent Travelers Property Casualty Co. in the case MDC Acquisition Co. et al. v. Traveler’s Property Casualty Co. of America, case number 12-4340, in the U.S. Court of Appeals for the Sixth Circuit.

Travelers asked the court in February 2013 to uphold a finding that it had no duty to cover medical supply companies MDC Acquisition Co. and RGH Enterprises Inc. in litigation over their practice of sending allegedly junk fax advertisements. An Ohio federal judge in September 2012 granted Travelers’ motion for summary judgment, ruling that a policy exclusion called the unsolicited communications endorsement applied. MDC and RGH appealed, saying the exclusion did not apply and they were entitled to defense and indemnification costs.
