The case involved a 38-year-old bicyclist, training for a triathlon, who was injured when the defendant backed his vehicle out of his driveway and collided with the cyclist, resulting in a broken ankle and shoulder. The injury prevented the plaintiff from participating in future triathlons, and medical testimony indicated an increased risk of arthritis.
During trial, David skillfully challenged the plaintiff’s account, demonstrating that the cyclist saw the driveway three houses away but failed to slow down. Plaintiff’s counsel argued the defendant was entirely at fault and sought $900,000 in compensation. David countered that the plaintiff was more than 50% responsible for the accident, emphasizing contributory negligence and advocating for no recovery.
After two hours of deliberation, the jury awarded just $98,000 in total damages, reduced to $57,000 after liability apportionment—far below the plaintiff’s negotiation demand of $900,000. This outcome underscores David’s commitment to defending his clients and securing fair results in the courtroom.
