Congratulations to Chicago-based partner, Joseph P. DiPino and attorney Thomas J. Brophy for their recent victory in the Chancery Division of Cook County. This case arose from an incident in which the insured while carrying fares for hire collided with two other cars causing four fatalities.
Our team filed a declaratory judgment action in the Chancery Division of Cook County to declare that the policy failed to cover the occurrence based on the policy language excluding coverage for an insured while driving fares for hire. The court agreed and found that the policy language excluded coverage for the incident and that the policy contained no ambiguities. Accordingly, the court entered judgment in favor of our insurer client finding that it owed no duty to defend and no duty to indemnify for the incident.
