Meagher & Geer partner Kurt Zitzer and co-counsel Ray Rittenhouse of Mulherin, Rehfeldt & Varchetto of Wheaton, IL recently earned a significant win for client Scottsdale Insurance. The U.S. District Court for the Northern District of Illinois ruled that Scottsdale Insurance Company had no obligation to defend, or indemnify a city’s police department after the city failed to provide timely notice of a claim, and that Scottsdale was not estopped to raise the late notice defense even though it did not immediately file for a declaratory judgment before the conclusion of the underlying case. American Safety Casualty Insurance Company vs. City of Waukegan, 2009 WL 855795 (March 30, 2009).
