The Minnesota Supreme Court recently denied review of a Court of Appeals decision affirming a complete defense team victory for Meagher + Geer attorneys Timothy Schupp, Robert Vaccaro, and William Hart in a long-running commercial litigation matter valued in excess of $173MM.

The case, Aegis Insurance Services, Ltd. and other interested insurers as subrogees of Northern States Power Co. and Southern Minnesota Municipal Power Agency v. General Electric Company, et al., Case No. A19-0640, involved property damage and other claims stemming from the catastrophic failure of a coal-fired steam turbine in Becker, Minnesota on November 19, 2011. In November 2013, subrogated property insurers and others commenced the action against the turbine’s manufacturer and related subsidiaries in Sherburne County District Court.  Meagher + Geer attorneys representing the manufacturer tried the case to the jury in October 2018, which found the manufacturer was not liable for the loss.

The Court of Appeals affirmed the trial court’s decision on February 10, 2020, and the Minnesota Supreme Court denied review on April 28, 2020.  A copy of the Court of Appeals decision in the matter is available here.
